Terms & Conditions - the basics
These Terms and Conditions govern all agreements for painting, illustration, branding, design, or related creative services provided by the contracted John F Smith (JFS Artist) to a company or client (“Client”). By engaging the Artist, the Client agrees to the following terms.
1. Contract Approval
All projects require a written and signed contract before work begins. The contract will define the scope of work, creative direction, deliverables, timelines, pricing, payment terms, revision limits, and usage rights. Verbal agreements are not binding.
2. Deposit and Payments
A non-refundable down payment is required prior to the start of any work. The remaining balance must be paid according to the schedule outlined in the contract and in full before final artwork or branding assets are released.
3. Scope of Work and Revisions
Work will be completed strictly within the agreed scope. Any changes, additions, or revisions beyond what is specified in the contract may result in additional fees and adjusted timelines.
4. Cancellations and Termination
If the Client cancels the project after work has begun, the deposit will be retained by the Artist to cover time, labor, and resources. Additional fees may apply depending on the stage of completion, as outlined in the contract.
5. Ownership and Usage Rights
Unless otherwise stated in writing, the Client owns the final approved artwork or branding deliverables upon full payment. All reproduction, publishing, licensing, or commercial usage rights remain with the Artist unless expressly transferred in the contract.
6. Client Responsibilities
The Client agrees to provide accurate information, reference materials, and timely feedback. Delays in approvals or responses may impact project timelines.
7. Creative Discretion
The Artist retains creative discretion to interpret the project in alignment with the agreed concept, professional standards, and artistic integrity.
8. Limitation of Liability
The Artist shall not be liable for indirect, incidental, or consequential damages arising from the use of the artwork or branding materials, except where required by law.
9. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with applicable local and state laws.
10. Acceptance
Execution of a contract and submission of payment constitutes acceptance of these Terms and Conditions in full.
